1. All services and software are provided by Presence Group Ltd (the company), and are on an ‘as is’ and ‘as available’ basis with no warranties of any kind. This does not affect your statutory rights.
2. By using SpeedyTests.co.uk, and providing us with your driving licence number, you agree to us changing your driving test date and time on your behalf.
3. The company has no affiliation with the Driver and Vehicle Standards Agency (DVSA). Signing up to this service does therefore not guarantee to find you an earlier test date/a cancellation/test matching your criteria.
4. We cannot confirm exact test dates and times, but only reserve them, and will confirm the booking once we have heard back from you that the date and time are suitable (unless Auto-Book is used). Reservations which have not been converted to bookings expire after approximately 15 minutes. The reservation period begins when we reserve the test on the DVSA system. We cannot be held responsible for delivery delays or errors with the SMS and email networks, any delays or errors could mean that your reservation notification/reply arrives after the expiry period or in some cases may not be delivered.
5. It is the user's responsibility to change/cancel a booked test date, if needed, i.e. to avoid losing the DVSA fee. The user needs to ensure they know the last day they can change or cancel their test with the DVSA. We are not responsible for any amount lost due to booked short notice tests or the user not changing/cancelling their test within the specified timeframe for the DVSA refund.
6. We cannot be held responsible and no refunds will be given if the DVSA or driving instructor changes the date and/or time of your test, or cancels the test for any reason, including, but not limited to: driving examiner illness, strikes, test centre closures, local/national Covid-19 lockdowns and weather conditions (such as snow, ice or fog). This also applies to learner drivers cancelling their test/not being able to attend for any reason.
7. The learner driver is responsible for turning up to the driving test, taking the correct documents and ensuring that the car they use is suitable for the test. We cannot be held responsible for any tests cancelled due to reasons that are the responsibility of the learner driver or their driving instructor including, but not limited, to the above learner driver responsibilities.
8. If we're unable to find a test within the timeframe you provide on your account, meaning, we have not sent a notification of a test appointment matching the dates specified, or Auto-Booked a test as requested and you or somebody else hasn't changed your test date, we'll be happy to provide you with a full refund up to 30 days after your purchase. Booking a test found is not required for our service to be complete, regardless of the reason for not booking. A refund can be requested by emailing [email protected] from your SpeedyTests email, the search should be stopped by the user at the same time, (no refund will be issued if a test is found after the request). If we have sent an error email or text, please see section 9.
9. If when we attempt to start your service, we are unable to login with the information provided, have an error within your DVSA account or there is no active booking with the DVSA, we will notify you via email/text of the error(s) for you to resolve. If a refund is requested (within 30 days of payment) and the error has not been fixed or it has taken longer than 24 hours to fix or the account received more than 5 paused notifications, an admin fee of £2 will be deducted from the refund.
10. The criteria (date time frame and test centre/s) specified on the account is the responsibility of the account user and should be suitable at all times. We search based on the details provided, so can bring tests forward, backwards, change test location and find short notice tests. Full payment made for the service we provide will be retained if a test is found/Auto-Booked matching the criteria, even if the test found/booked cannot be taken for any reason or the criteria specified was incorrectly entered/not amended by the user.
11. If the criteria chosen is during lockdown timeframes (all or majority), resulting in no tests found, a £2 admin fee will apply upon refund (within 30 days of purchase).
12. Certain paid account types may be upgraded by the user at any time but it is not possible to then downgrade those accounts. Any upgrade fees paid are non-refundable unless we are unable to find a test for you.
13. As per the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you are entitled to cancel your purchase and request a full refund of your payment, within 14 days from purchase, as long as the service is yet to begin. The service starts as soon as we enter your details on the DVSA website, which is shortly after payment and entry of your preferences.
14. We will record details of usage of the service including, but not limited to, your personal details provided at the time of taking out the services, search times, dates and times that are found, and emails and SMS messages that are sent to you, and received from you.
15. By giving us your details you agree to us passing your information to the DVSA in order to change your driving test. If you are using our Apple or Google Android push notification apps, driving test alerts will be sent to you by our third-party communication supplier based in the USA. We will not send them your personal information. All details will be held by us in accordance with the Data Protection Act.
16. It is the users' responsibility to provide valid and correct contact information so that we can notify you of cancellations and any errors, no refund will be given if the email/mobile number provided is invalid/incorrect.
17. Each account purchased from us can only be used to search for practical driving tests on behalf of the owner of the driving licence number that is entered in the driving licence number box on the account preferences form. We reserve the right to suspend accounts without refund where we believe the account is not being used according to this rule.
18. By registering your details with the company, you agree to the company sending you emails and SMS messages to the email address and mobile telephone number you provide on registration. Your personal details will not be passed on to third parties.
19. By signing up to our service you agree to not check the DVSA for cancellations and not using another cancellation checker/have someone else check for cancellations on your behalf. Doing so will invalidate your refund as you will be affecting our systems, irrespective of how many times your account was logged in elsewhere or if we have notified you of any tests. (You may only log in to the DVSA site if you need to change a test to a later date to avoid losing your DVSA fee, to cancel your test or to check your test has been changed). If a refund is requested within 24 hours of payment because you were already using another cancellation checker and no tests have been found by us, then a £1 processing admin fee will apply.
20. Driving instructors/driving schools are not permitted to sign up/pay on behalf of pupils (as learner accounts) under their personal/work emails. We reserve the right to suspend accounts without refund where we believe the account is not being used according to this rule.
21. The integrity of this system relies on proper use of email and SMS messages as a message passing media. The use of the email or SMS message system(s), directly or indirectly as a spamming tool, or other than it is intended, is prohibited.
22. Our service is a one-off payment for unlimited use. Any extra accounts under the same licence number/reference will be subject to a £1 admin fee charge which will be deducted from each extra account paid upon refund, within 30 days of payment. (Even if no test was found through the extra account/s). If you have 'upgraded' your account, we will refund the lowest amount along with the admin fee. If more than one account is being used by the user at the same time and or a test is found on any account, that account will not be eligible for a refund (if a test is found on each account then those accounts will not be refunded). The user or admin can decide which account to keep active if the service is still needed (usually the account that has had cancellation(s) found on it).
23. We do not take responsibility for any failed bookings or booking errors that are due to a fault of the DVSA website, as this is outside of our control. By signing up to our service you accept that such errors may happen and that no refunds will be given if booking failures/errors occur on your account. There may also be periods where the search for cancellations cannot be conducted due to the DVSA website being unavailable. Learners should not make arrangements until they have confirmation from us and the DVSA of their new test date.
24. Your booked test should be at least 10 days away when signing up to our service, if the search was shorter than 5 days and refund is requested, an admin fee of £1 will be deducted upon refund, (within 30 days of purchase).
25. The search criteria should be at least 4 days long (excluding day of sign up and weekends). If the criteria included short notice tests/the search lasted less than 5 days, a £1 admin fee will be deducted from the refund if no tests have been found and a refund is requested, (within 30 days of purchase).
26. The DVSA require a 10 working day wait in between test fails, your criteria should start from the 10th working day from the failed date, no tests before this date will show on your DVSA account. Failure to provide sufficient criteria resulting in no tests being found, will result in a £1 admin fee upon refund.
27. The DVSA have two types of tests, weekday for £62 and weekend/evening/bank holiday for £75. If you want our service to find/book a weekend/evening/bank holiday test, then you must pay the DVSA the higher price prior to using our service. If a refund is requested for this reason or because a test could not be found due to only weekend days being selected on your criteria and all other terms and conditions have been adhered to, a £2 admin fee will apply upon refund.
28. Signing up without a theory/test reference will mean that we cannot search for cancellations on your behalf until we have all of your DVSA details. If you choose to add this on after payment, you must do so within 24 hours of signing up in order to be covered by our money-back guarantee. If 24 hours passes and no reference has been added and refund is requested (within 30 days of payment), £1 admin fee charge will be deducted from the refund.
29. Failure to find out if our service is suitable for you prior to payment will result in an admin fee of £1 upon refund. Including, but not limited to: assuming we find theory, motorbike, LGV, instructor, extended test cancellations, automatic to manual licence upgrade, search in NI, send email/WhatsApp notifications, text non UK numbers, allow more than one number per account, exclude dates from search, search for a test centre not on our list or search for more than 3 test centres per account. Information can be found on our website or by emailing us with your questions prior to payment, (contacting us then paying without receiving an answer does not count and the fee will be deducted).
30. We reserve the right to deactivate/close accounts at our discretion without a refund or warning if the user misuses our service and/or opens a PayPal/bank case.
31. We reserve the right to amend our terms and conditions at any time without advanced warning.
SpeedyTests provides its services to you subject to the following terms & conditions, which you accept by using the service. SpeedyTests may be referred to as 'the company' throughout this.

All content included on this site, including text, graphics, logos, button icons, images and software, is the property of the company or its content suppliers and is protected by international copyright laws. All programs used on this site are the property of the company or its software suppliers and are protected by international copyright laws. Any attempt at reverse engineering, disassembly, or de-compilation of programs, unless it is explicitly permitted, is prohibited by law.
4. The company may send notices to you or your pupils via either email or regular mail. The company may also provide notices of changes to the terms or other matters by displaying notices or links to notices to you generally on the services provided by the company.

8. SpeedyTests may choose to change prices, however all users will be notified prior to any implementation and will be given the option to cancel services if they so desire. This is likely to be done via e-mail and notifications across the website.
9. By signing up to SpeedyTests, you consent to us recording your personal details and communicating with you via email and SMS.
10. Prior to being permitted full access to the ADI dashboard, you may be subject to an authentication check by our Partner Department. This is to ensure that you are a DVSA Approved Driving Instructor (regardless of level of qualification) and to prevent the reselling of our service through other public mediums.
11. All services provided by SpeedyTests are paid for in advance and must be activated within 90 days of purchase. SpeedyTests operates a no refund policy for services paid for in advance.

If a refund is requested within 24 hours of payment because you/the learner were already using another cancellation checker and no tests have been found by us, then a £1 processing admin fee will apply.
28. Access to the ADI dashboard is subject to Internet availability. The company will not accept responsibility for any interruptions to the service due to a poor, or no, Internet connection.
29. SpeedyTests will not be held liable for any delays or failure in performance from any cause beyond our control. This includes, but is not limited to, any loss of business, revenue, profits, data or use, errors or omissions in the data you enter, acts of God or acts of third-party Internet service and storage providers.
30. SpeedyTests will not be held liable for any third party service delays or failures from any cause beyond our control.
31. SpeedyTests will not be held liable service delays or failures from any third party payment providers, such as PayPal. This includes, but is not limited to, not completing a transaction on time and occasional restriction of access to allow for repairs.
